In Ashfold v Metro Brick [1999] WASCA 1048 I represented an injured brick setter whose rate of weekly workers compensation payments had been calculated using hourly rates. But the worker had at all times worked on piece rates, and earned an amount much greater than hourly rates. The appeal was successful and my client had his weekly payments increased, backdated to the date of his injury.
